Terms of Service

These terms cover your use of Neon.Shop, including the site, the sign customizer and anything you buy from us. By browsing the site or placing an order, you agree to them. If you don't agree, please don't use the site.

They apply to everyone who uses Neon.Shop: browsers, customers, vendors and anyone contributing content. Other policies we link to, including our Privacy Policy and Refund Policy, form part of these terms. Our store is hosted on Shopify, which provides the platform that lets us sell to you.

New features and tools we add to the store are covered by these terms too. We may update them from time to time by posting a revised version on this page, and continuing to use the site after that counts as accepting the change.

Who can order

You need to be at least the age of majority where you live to buy from us, or have the consent of a parent or guardian. You agree not to use our products or the site for anything illegal, and not to break any law that applies to you.

You also agree not to transmit any virus, worm or destructive code through the site. Breaking any of these terms may end your access immediately.

Orders, proofs and production

Placing an order is an offer to buy. We accept it when we send your order confirmation. We can refuse or cancel any order, including where we suspect fraud, where a price or description was published in error, or where an order looks like it came from a dealer or reseller.

Custom signs are made only after you approve a digital proof. The proof shows your exact text, layout, dimensions and colour. Check it carefully, because what you approve is what we build. Once approved, your sign goes into production and the terms in our Refund Policy govern changes, cancellations and claims.

You agree to give us accurate and complete account, billing and delivery information, and to keep it up to date so we can complete your order and reach you if there's a problem.

The design you send us

You keep ownership of the artwork, logos and wording you upload or type into the customizer. By submitting them you confirm that you own them or have permission to use them, and that producing your sign won't infringe anyone else's copyright, trademark or other rights.

You give us permission to use your design for the purpose of quoting, proofing and manufacturing your sign, and to keep a record of it for support and warranty claims. We may decline any design we believe infringes someone's rights, or that is unlawful, hateful, obscene or otherwise unsuitable, and refund you if we've already taken payment.

If a third party brings a claim against us because of a design you supplied, you agree to cover our reasonable costs in dealing with it.

Pricing and payment

Prices are shown in US dollars and can change at any time before you order. Custom sign pricing depends on the size, character count, colour and options you choose in the customizer, and the price you see at checkout is the price you pay.

Payment is taken in full when you order, because production starts from your approved proof. If a price is listed incorrectly through a technical or human error, we'll contact you before charging you and you can confirm the corrected price or cancel for a full refund.

We may change or discontinue any product, option or part of the service at any time, and we aren't liable to you or anyone else for doing so.

Products, colour and accuracy

We work hard to show our signs accurately, but screens vary and no two displays render colour the same way. Slight differences between what you see on your screen and the sign you receive are normal and aren't grounds for a refund on their own.

Because every sign is handmade, small variations in bend, spacing and finish are part of the product. Sizes are approximate to within a small tolerance.

Some products may be available only online, in limited quantities, and subject to our Refund Policy. We may limit sales by person, region or quantity, and any offer we make is void where it is prohibited.

Shipping and delivery

Free US shipping applies to the destinations listed at checkout. Production and delivery times shown on the site are estimates, not guarantees, and they start once you approve your proof.

Risk passes to you on delivery. If your sign arrives damaged, follow the claim process in our Refund Policy and we'll put it right.

Using your sign safely

Our signs are LED and low voltage, but they're still electrical products. Use the power supply we send with your sign, keep it indoors unless you bought an outdoor-rated sign, and follow the mounting and care instructions included with your order.

Don't rewire, modify or repair a sign yourself. Doing so voids the warranty and we aren't responsible for any damage or injury that follows. Signs are decorative products and aren't intended for use as emergency, safety or exit lighting.

Reviews, comments and other submissions

If you send us ideas, suggestions, reviews or other material, whether we asked for them or not, we may use, edit, publish and share them without restriction and without paying you. We're not obliged to keep them confidential or to respond to them.

You agree that anything you submit is your own, isn't unlawful, abusive, defamatory or obscene, contains no malware, and doesn't impersonate anyone. We may remove content we consider unsuitable, though we're not obliged to monitor it, and you're responsible for what you post.

Prohibited uses

You may not use the site or its content:

• For any unlawful purpose, or to encourage anyone else to break the law.
• To infringe our intellectual property or anyone else's.
• To harass, abuse, defame or discriminate against anyone.
• To submit false or misleading information.
• To upload viruses or any code that could affect how the site works.
• To collect or track other people's personal information.
• To spam, phish, crawl or scrape.
• To interfere with or get around the site's security features.

We may end your access to the site for breaking any of these.

Our intellectual property

The Neon.Shop name, logo, site design, photography, product designs and written content belong to us or our licensors. You may use the site for your own personal, non-commercial purposes. You may not copy, resell or exploit any part of it without our written permission.

Section headings in these terms are there for convenience and don't affect how the terms are read.

Third-party links and content

The site may link to or include material from third parties. We don't review or control those sites and we're not responsible for their content, accuracy or practices, or for anything you buy from them. Read their terms before you use them, and take any complaint about them up with them directly.

Accuracy of information on this site

Content on the site is provided for general information and may occasionally contain typographical errors, inaccuracies or omissions relating to descriptions, pricing, promotions, shipping charges or availability. We may correct errors and cancel or change orders affected by them, including after you've submitted an order, and we'll always tell you before we do.

We aren't obliged to update information on the site, and a date shown on a page doesn't mean everything on the site has been revised.

Disclaimers and limitation of liability

We don't guarantee that the site will be uninterrupted, secure or free of errors, or that the results you get from using it will be accurate. Except where these terms or our warranty say otherwise, the site and everything on it is provided as is and as available, without warranties of any kind, whether express or implied.

To the fullest extent the law allows, Neon.Shop and its owners, staff, suppliers and service providers aren't liable for any indirect, incidental, special or consequential loss arising from your use of the site or our products, including lost profits, lost data or replacement costs. Where liability can't legally be excluded, it is limited to the amount you paid for the order in question.

None of this affects rights you have under consumer law that can't be excluded, including our obligations for faulty goods set out in the Refund Policy.

Indemnity

You agree to cover our reasonable costs, including legal fees, for any claim brought by a third party arising from your breach of these terms, from a design you supplied, or from your breach of any law or anyone else's rights.

General terms

Personal information

Information you give us through the store is handled as described in our Privacy Policy.

Termination

Either of us can end this agreement at any time. Yours ends when you stop using the site. We may end it, and withdraw your access, if you break these terms. Anything either of us owed before the end still stands.

Severability

If any part of these terms turns out to be unenforceable, that part is separated out and the rest still applies.

Entire agreement

These terms, together with the policies we link to, are the whole agreement between us about your use of the site, and replace any earlier version. Any ambiguity in them won't be read against us simply because we wrote them.

Governing law

These terms are governed by the laws of the State of [State], United States, and the courts of that state have exclusive jurisdiction over any dispute.

Changes

The current version of these terms is always on this page. We may update them at our discretion, and it's your responsibility to check back. Using the site after a change means you accept it.
